Kansas: Emergency Safety Interventions K.A.R. 91-42-1 and K.A.R. 91-42-2
In February 2013 the Kansas Department of Education adopted regulations for the use of Emergency Safety Interventions (ESI). These regulations are effective as of April 19, 2013. A task force that includes CPI has been convened to draft a technical assistance document to provide Kansas school districts with best-practice recommendations for implementing Emergency Safety Interventions (ESI) K.A.R. 91-42-1 and K.A.R. 91-42-2.

About the Kansas Regulations for the Use of Emergency Safety Interventions
Kansas’s regulations for the use of ESIs are intended to ensure that school staff have the skills to handle violent student behavior in a manner that’s as safe as possible for both students and staff. They limit the use of physical restraint in schools to only situations in which a student presents an imminent danger of physical harm to self or others.
 
The regulations prohibit the use of prone and supine physical restraint and any physical restraint that obstructs a student’s breathing or impacts a student’s primary mode of communication. Additionally, they require schools to:
 
  • Train staff in prevention and de-escalation techniques, as well as Positive Behavioral Interventions and Supports (PBIS) strategies.
  • Train personnel in the use of emergency safety interventions.
  • Collect data about and document each use of physical restraint.
  • Notify parents when their children have been restrained.
