Kansas SB 193, Regarding Restraint Use in Schools
KS SB 193 was adopted on May 10, 2016. This legislation, along with the Emergency Safety Intervention regulations in the Kansas register, constitute laws around restraint and seclusion for Kansas Public Schools and accredited non-public schools that receive public funding. This law took effect on June 1, 2016. Important points of the bill include:
  • Prone and supine restraints are banned. Chemical restraint is banned unless the person administering it is licensed.
  • It requires each school board to develop written policies that mandate training.
  • Training must:
               1. Be a nationally recognized training program.
               2. Address prevention techniques, de-escalation techniques, and positive
                   behavioral intervention strategies.
               3. Be based on staff duties and possible involvement with restraint.
               4. Have written or electronic documentation.
  •     School security officers are not exempt from the act, while police officers are exempt  
        if they are engaged in law enforcement duties.
