Nebraska LB 698, Requiring Memory Care Endorsement for Assisted Living Facilities
Nebraska LB 698, passed into law on March 30, 2016, requires a memory care endorsement from the Nebraska Department of Health and Human Services, which assisted living facilities are required to obtain if they wish to self-identify as memory care facilities through advertising or other promotion.
 
Key points include:
  • The bill creates a memory care endorsement for assisted living facilities.
  • In order to qualify for the memory care endorsement, an assisted living facility must provide proof of meeting the qualifications the Department will adopt related to staffing enhancements, staff training, dedicated memory care programming, cultural competencies, facility requirements, and security issues.
  • The bill allows only an assisted living facility that qualifies for the endorsement to advertise itself as an endorsed memory care facility and to qualify for reimbursement.
  • It requires the Department to make recommendations regarding a higher or supplemental reimbursement rate for assisted living facilities which have a memory care endorsement and provide care for persons with cognitive impairments or dementia.
