Pending New Mexico Legislation HB 190 Prohibits Restraint and Seclusion in Schools Except in Emergency Situations

Pending New Mexico HB 190 [PDF] was introduced on January 20, 2016. The bill relates to rules concerning the use of restraint and seclusion in schools:

  • The bill requires all school districts and charter schools to adopt policies and procedures with respect to the use of restraints and seclusion.
  • The bill mandates restraint and seclusion may be used in an emergency situation only to the extent necessary to protect a student or another person from imminent, serious physical harm.  
  • Physical restraint and seclusion in emergency situations must be administered by staff trained in evidence-based crisis intervention training that provides de-escalation training and first aid, including how to identify signs of medical distress.
