On June 7, 2006, New York enacted legislation creating a new section of the New York State Labor Law that requires public employers to minimize the risk of workplace violence and ensure that all New York State public workplaces are safer for the workers and the public they serve. The law, which was published in the state register on April 29, 2009, requires public employers to take specific actions, including:
Perform a risk evaluation at each work site.
Employers are required to examine records that concern workplace violence incidents to identify patterns in the type and cause of injuries. The risk evaluation should include an assessment of relevant policies, work practices, work procedures, and the physical environment.
Develop a written workplace violence prevention program.
Employers with a combined total of 20 or more full-time permanent employees must develop a written workplace violence prevention program. Employers with less than 20 employees must still comply, but the requirement that the program be written is waived.
Train employees on how to avoid and respond to acts of violence.
Upon completion of the workplace violence prevention program, employers must provide each employee with information and training on the risks of workplace violence in their workplace at the time of an employee's initial assignment and at least annually thereafter.
What public employers are covered by this law?
According to the New York State Workplace Violence Prevention Law, the term public employers includes state, counties, cities, towns, public authorities, public benefit corporations, and any other governmental agency or instrumentality. This law does not, however, apply to employers defined in Section 2801-a of the New York State Education Law. Also, private employers are not covered, as they are under the jurisdiction of the Federal Occupational Safety and Health Administration (OSHA).
