A new amendment to Minnesota ADC 9544.0090, effective immediately, was adopted on August 17, 2015, and calls for de-escalation and restraint training for caregivers and facilities that are licensed to serve persons with a disability or persons age 65 or older, as follows:
  • It applies to all individuals licensed for services to persons with a developmental disability or related condition and providers of home and community-based services to persons with a disability or persons age 65 or older.
  • Requires that the license holder ensure that staff which are involved with development, implementation, monitoring, supervision, or evaluation of positive support strategies complete a minimum of eight hours of training.
  • Requires the license holder to document the progress or lack of progress toward each outcome or goal for each person under their care.
  • Training must require staff to demonstrate knowledge of:
    • De-escalation techniques
    • The safe and correct use of manual restraint
    • Personal staff accountability and staff self-care after emergencies
    • Principles of positive support strategies such as positive behavior supports
    • Prohibited restraints
