Congressman George Miller (D-CA) and Congressman Gregg Harper (R-MS) have reintroduced the Keeping All Students Safe Act to ensure that educators throughout the US have the skills to manage violent student behavior safely.

About the Bill
The Keeping All Students Safe Act calls for all states to implement policies that limit the use of physical restraint and seclusion in schools. It also calls for school staff to be trained in safe and effective behavior management and crisis intervention techniques, and it may provide funding for states to implement its requirements.

This bill was previously introduced in the Senate as S. 2860, S. 3895, and S. 2020. Similar bills, H.R. 4247 and H.R. 1381, have been proposed in the House of Representatives.

If passed, H.R. 1893 will:
 
  • Limit the use of restraint and seclusion to emergency situations in which there is a threat of imminent physical danger.
  • Prohibit the use of mechanical restraints, chemical restraints, and physical restraints that impede breathing.
  • Require schools to inform parents on the same day if their child is restrained or secluded.
  • Promote alternatives to the use of restraint such as positive behavioral interventions and supports (PBIS).
  • Require schools to collect data about their use of restraint and seclusion.
  • Require school staff to be trained in de-escalation techniques as well as safer, less restrictive physical interventions to be used only as a last resort.

The bill is intended to ensure that school staff have the skills to handle violent student behavior in a manner that’s as safe for both students and staff as possible.
