Oklahoma HB 3127 was proposed in January of 2016. The bill places several restrictions on the restraint and seclusion of students with disabilities. The bill:
- Prohibits school district personnel from using physical restraint or seclusion on students with disabilities for disciplinary purposes.
- Prohibits the use of chemical, mechanical, or prone restraint on students with disabilities.
- Only allows seclusion and restraint on students with disabilities if the actions of the student pose an imminent risk of harm to the student or others and less restrictive measures appropriate to the behavior exhibited by the student have not effectively de-escalated the risk of injury.
- Requires school personnel doing restraint on students with disabilities to have training through a nationally recognized training program in:
1. Conflict de-escalation;
2. The crisis cycle and interventions at each stage;
3. The possible effects of physical restraint.
