Reducing Restraint in Indiana Schools: Senate Bill 345
When Indiana Senate Bill 345 passed in April 2013, the law required a commission to be established to adopt rules concerning the use of restraint and seclusion in Indiana schools. The commission was also required to develop a model restraint and seclusion plan, and schools are required to have restraint and seclusion plans in place beginning in the 2014–2015 school year.
About the Law
The final rule, Title 513 Commission on Seclusion and Restraint in Schools [PDF], calls for seclusion and restraint to be used only as a last resort when a student presents an immediate danger of physical harm to self or others. The rules require all schools (including public, charter, and accredited nonpublic schools) to use prevention, PBIS, and conflict de-escalation strategies to minimize or eliminate the need for the use of restraint or seclusion. The rules also require that each school’s staff be trained on a recurring basis according to the school’s adopted plan on the appropriate use of effective alternatives to physical seclusion and restraint. Training is required to include:
- Positive Behavioral Intervention and Supports (PBIS)
- Conflict de-escalation techniques
- Steps to avoid the use of seclusion and restraint
- How to use seclusion and restraint more safely when needed as a last resort
- Debriefing practices and procedures
Schools are also required to maintain training and incident documentation.
